Court upholds Lagos government restriction on Okada, Keke napep in 15 councils

A Federal High Court in Lagos State has upheld the Lagos State Government’s right on the restriction of commercial motorcycles (Okada) and tricycles (Keke Marwa) within six Local Government Areas and nine Local Council Development Areas in the State.

In January 2020, Lagos State Governor, Babajide Sanwo-Olu, signed an Executive Order restricting the movement of Okada and Keke Napep in the 15 councils.

The order was countered by a lawyer identified as Olukoya Ogungbeje, who approached the court to challenge the directive.

On Tuesday, the Lagos State Attorney-General and Commissioner for Justice, Moyosore Onigbanjo (SAN) filed a notice of preliminary objection and counter affidavit in the Fundamental Human Rights’ application.

Justice Liman, delivering the judgment, upheld the arguments of Onigbanjo that the restriction of motorcycles and tricycles on major roads in the state is in line with the provisions of the Transport Sector Reform Law, 2018.

He further dismissed the suit filed by Olukoya Ogungbeje challenging Governor Babajide Sanwo- Olu’s executive order authorizing the restrictions.

The court said, “The restriction of motorcycles, tricycles within six Local Government Areas and nine Local Council Development Areas in the State is not an infringement of Fundamental Human Rights.”
