A human right lawyer, Malcom Omirhobo has challenged the ‘planned move’ to confirm the appointment Justice Tanko Mohammed as the substantive Chief Justice of Nigeria.
Omirhobo said based on 1999 Constitution it was unlawful for the office of the CJN to be declared vacant on January 25, 2019, and consequently, appointment and swearing in of Tanko as the acting CJN was also unlawful.
He also wants the court to declare that the suspension and/or removal of suspended Chief Justice Walter Onnoghen from office is a shared responsibility of the executive, judiciary and legislature.
He said President Muhammadu Buhari does not have the power under the law to unilaterally suspend and/or remove the CJN from office.
